Malicious prosecution can take two forms: criminal and civil, depending on who does the prosecution.
Have you been charged and prosecuted with a crime you did not commit because someone maliciously made a false report to the police?
If so and if you suffered damages as a result, you may have the right to sue the person who made the false report, if you were acquitted of the charges.
Have you been maliciously and wrongly sued by someone else or at that person’s insistence?
If so, and if you suffered damages as a result, you may have the right to sue the person who sued you or who instigated the lawsuit, if you won the lawsuit.
